🐔 WHAT’S COOKIN’ IN FREIGHT

📉 What Happened to Forward Air's Stock? Forward Air's (FWRD) stock has plummeted nearly 90% this year due to the controversial $2.1 billion merger with Omni Logistics, legal battles, and leadership exits. CEO Tom Schmitt and CFO Rebecca Garbrick's departures added to investor concerns. The Q1 loss of $0.64 per share, coupled with a Fitch downgrade, highlights financial struggles. New CEO Shawn Stewart aims to turn things around, but the road ahead is rocky. Just this week, the company's shareholders filed a class action complaint, contesting the merger. Forward Air's future hinges on reducing debt and regaining investor confidence.

🤖 FleetWorks Showcases Real-Time Freight Negotiation With AI. With the release of its newest video, FleetWorks is driving some interesting conversations about AI in freight. Their AI, Felice, negotiates a carrier’s rate from $800 to $700 before transferring them for a simple confirmation call. CEO Paul Singer claims this tech helps brokers book 30% more freight. Some commended the tech for its capabilities being on par with current freight brokers but said that's not enough to improve business. Andrew Silver notes that the AI still has some kinks to work out and says he is not sold on the value this offers just yet.

Will New Bill Bring End to Freight Fraud?

Trucking industry groups are rallying behind a new bipartisan bill aimed at cracking down on freight fraud. Introduced by Reps. Eleanor Holmes Norton and Mike Ezell, the Household Goods Shipping Consumer Protection Act aims to give the Federal Motor Carrier Safety Administration (FMCSA) more muscle to take down shady operators. Here's what you need to know:

The Key Provisions:

  • Civil Penalties: The bill empowers FMCSA to impose $10,000 civil penalties on entities violating commercial regulations.
  • Stricter Registration Requirements: Brokers, freight forwarders, and carriers must provide valid business addresses and disclose any connections to other regulated entities.
  • Enhanced Enforcement: FMCSA can withhold, suspend, amend, or revoke registrations for non-compliance.

Industry Impact:

  • Freight Fraud Costs: Fraud, including double brokering and load phishing, costs the industry over $800 million annually.
  • Double Brokering: The bill targets double brokering, a major issue where loads get re-brokered without shippers knowing. No more fake addresses or ghost operations.

Support from Key Players:

  • OOIDA: "Freight fraud committed by criminals and scam artists has been devastating to many small business truckers," said Todd Spencer, President of OOIDA. OOIDA represents 150,000 small-business truckers and is pushing hard for this bill.
  • TIA: Anne Reinke, President & CEO of TIA, emphasized, "Fraudulent activities not only cause significant financial losses but also undermine public trust in institutions and markets."

Why It Matters:
This bill impacts all carriers and brokers. By clearly defining what constitutes a valid principal place of business, the bill aims to make it impossible for scammers to operate. This is crucial for freight brokers, as it will help weed out fraudulent activities and protect legitimate businesses.

However, while the bill has strong support from major industry organizations like OOIDA, TIA, and CVSA, many in the industry remain skeptical. The concern is that without proper enforcement, the new rules will just be another set of guidelines that fraudulent operators will find ways to bypass.

"Is this new? Principal Place of Business violations have been an issue for quite some time... If the application were vetted properly in the first place, the enforcement action would be a moot point." – Dale Prax, Founder of FreightValidate
