🌀 Atlantic Hurricane Season Forecasts Fewer Storms. AccuWeather has reduced its 2024 Atlantic hurricane season forecast, now predicting 16-20 named storms, including 6-10 hurricanes. Despite warm Atlantic waters, dry air and wind shear have hindered storm development. The season has already seen impacts, with Hurricane Beryl causing $28-32 billion in damage to Texas in July. As September, typically peak hurricane season, approaches, truckers are advised to seek alternative revenue sources rather than relying on FEMA loads. The National Hurricane Center has not yet adjusted its official forecast. The hurricane season continues through November 30.

💰 Portex Raises $6.5 Million for SMBs. Portex, a freight management startup founded in 2022, has secured $6.25M in seed funding to simplify logistics for small and midsize businesses. Led by ex-Flexport employee Brittany Ennix, the company offers an AI-powered platform that integrates with existing workflows, automates processes, and provides real-time analytics. Early results show significant time and cost savings for users, with up to 30% reduction in annual freight spend and 25 hours saved weekly on manual tasks. With plans for AI-powered updates and team expansion, Portex aims to tackle the $4 trillion global freight market by focusing on the underserved SMB segment.

🚢 US Port Strike Threatens Industry. The International Longshoremen's Association (ILA) is threatening a strike that could paralyze US ports, jeopardizing 43% of imports and billions in daily trade. With an October 1 deadline looming, tensions are high between the ILA, demanding better pay and opposing automation, and the US Maritime Alliance. A Sea Intelligence study warns of prolonged slowdowns even after a short strike, which will no doubt have immediate blowbacks to manufacturing and retail sectors. As negotiations continue, the entire US economy watches anxiously, aware of the far-reaching consequences a port shutdown could trigger, especially with Harold Daggett, ILA president, telling workers to be ready to “hit the streets.”

The freight industry is closely watching the case of Werner Enterprises, which is set to appear before the Texas Supreme Court in December 2024. This comes after a series of lower court rulings holding Werner liable for over $100 million in damages stemming from a 2014 crash that tragically killed a 7-year-old boy and injured others.

Case Background

  • Date & Location: Dec. 30, 2014, on Interstate 20 near Odessa, Texas.
  • Accident Details: A pickup truck carrying the Blake family lost control, crossed the median, and collided with a Werner Enterprises tractor-trailer on icy roads.
  • Fatalities & Injuries: The crash killed 7-year-old Zachery Blake and left his 12-year-old sister a quadriplegic.
  • Werner's Liability: Werner was found liable for negligent training in winter driving despite the driver not being directly responsible for the collision.

In 2018, a trial court awarded the family over $100 million in damages, a decision that was upheld by a Texas appeals court in 2023.

Werner appealed once again, and the Texas Supreme Court has agreed to hear oral arguments in December 2024.

What’s at Stake?

This case falls under the growing category of nuclear verdicts—those exceeding $10 million—which are becoming increasingly common in trucking litigation. These cases have far-flung effects:

  • Liability Standards for Trucking Companies: If the Texas Supreme Court upholds the ruling, it could set a precedent that trucking companies bear responsibility not just for accidents but for insufficient training practices. This may drive other companies to implement stricter training programs and winter driving protocols to protect against future lawsuits.
  • Insurance Premiums: A 2020 study by the American Transportation Research Institute found that these awards have contributed to dramatic increases in insurance premiums for motor carriers, which can rise by as much as 47%* after a major lawsuit. This forces many smaller carriers out of business and drives up costs throughout the supply chain, ultimately impacting consumer prices for transported goods.
  • Future Appeals and Legal Strategy: Trucking and logistics associations, including the American Trucking Associations and U.S. Chamber of Commerce, are backing Werner's appeal. These organizations argue that the original verdict is an example of juries imposing outsized penalties on companies in an attempt to extract large sums. A successful appeal could provide these organizations with stronger grounds to contest future verdicts and reduce the frequency of such massive payouts.

Industry Implications

The Texas Supreme Court's decision to hear the appeal signals that this case could reshape the landscape for trucking liability. Earlier we wrote about the landmark case that reshaped broker liability.

In the case of Werner, if their appeal fails, it could reinforce the trend of these massive payouts, impacting trucking companies and brokerage operations that often partner with carriers. The stakes for the industry go far beyond this individual case, signaling a continued rise in legal and operational challenges that could stifle industry growth for years to come.

The 2014 crash that sparked this case occurred during dangerous winter weather conditions, which is relevant to one of 2024’s biggest threats: extreme weather events.

This adds another layer of risk for the trucking industry, which is heavily affected by weather. Companies are now investing more in driver training, real-time weather monitoring, and adaptive technologies to help minimize disruption, but the risk remains high. Legal cases like Werner's underscore the importance of being prepared for these conditions, both in terms of safety protocols and liability risks.
